FREE SPEECH ABOUT SCIENCE ACT (H.R. 4913)

 

Congressman Jared Polis of Colorado is a hero.  He has proposed a bill in congress that, if passed, will empower consumers, eliminate government censorship, build a healthier U.S. population, and save billions of dollars in healthcare costs by helping people make informed decisions.

 

The Free Speech About Science Act (H.R. 4913) acknowledges the need for Americans to take charge of their health – and empowers them to do just that!  The bill provides a clear definition of the types of research that may be referenced by growers and manufacturers.  Scientific data that fits these requirements may then be used market products.  For example, foods containing ample amounts of omega-3 fatty acids may advertise their health benefits based upon peer-reviewed scientific studies.

 

FDA regulations currently prohibit any reference to a scientific study by manufactures of a dietary supplement or producers of food relating to the health benefits.  Current federal law allows FDA to treat any reference to scientific studies about food or food supplements as an extension of the product’s “label” and as an illegal health claim.  This censorship by the FDA serves to stack the cards in favor of the pharmaceutical companies, and against food and supplements.

 

H.R. 4913 ensures that companies referencing peer-reviewed scientific research to support the health-claims of their products will not convert that food or dietary supplement into an “unapproved (and therefore illegal) new drug”.  This is the current model in operation.

H.R. 4913 will still grant the FDA and FTC the authority to pursue any fraudulent and misleading statements.  This will ensure that products are not falsely promoted, and in the case of legitimate science could motivate more scrupulous testing.
 

This bill creates a win-win situation for everyone involved!  It encourages the free flow of legitimate scientific research for consumers to make informed decisions.  It protects scientific research from government censorship.  Most importantly it allows Americans to make informed choices for their well-being and exercise personal responsibility.  This Bill represents Freedom in the truest sense of the word.

I am writing to express my approval of Jared Polis’ Free Speech About Science Act; and to urge you to vote in favor of this bill (H.R. 4913).  I believe this bill provides the solution to the current overgrowth of FDA regulations toward blatant censorship of scientific studies as they relate to the nutritional benefits of food and supplements.  Legitimate, peer-reviewed, scientific studies should be referenced by manufacturers and producers without converting a healthy food or dietary supplement into an unapproved drug.  We must protect the rights of the consumer to make informed decisions, and we must protect science from government censorship.  Bill H.R. 4913 represents Freedom in its noblest form.  Please vote in favor of this bill.
